AIt is recommended. Without a valid testament in Portugal after one’s death, we might have a conflict of laws (between the law where the assets are and the personal law); Therefore with will in Portugal, it is clear which law to apply and the wishes of the testor, saving time and money.

What guarantees do I have that a property belongs to the person selling it?
AIn Portugal all existent properties (urban or rustic) must be registered to be able to be transactedIf they are not registered they cannot be sold/boughtThat registration (which is public and nationalalso tells us whom are the current owners.

How can I know that there is a mortgage or charge over a property?
AThe same public registration also tells us whether any loans or mortgages exist.

How can I make sure that when buying there will be no leans/mortgages etc.?
AThat is exactly one of our duties. Before completion we make sure that no leans or charges or mortgages exist, or were properly cancelled/paid.
When taxes or condominium costs are involved we also obtain a certificate on inexistence of debts.
